Our Terms and Conditions comply with UK legislation, including the Distance Selling Regulations and are designed to ensure that all our customers can shop easily and with confidence with ourselves. As such, any disputes shall be adjudicated according to the laws of England and Wales. We maintain that, by confirming your order, you unreservedly accept our conditions of sale. These Conditions shall supersede all earlier conditions of M R Bennett Ltd These conditions shall take precedence over any conditions of the Customer and shall not be varied without the written consent of a director of M R Bennett Ltd. We conform to the requirements of the Data Protection Act, 1998.
THE CONTRACT
You will be sent confirmation of your offer to purchase the products shortly after your order. However, we do have the right to terminate the contract in the event that the goods are unavailable, mis-priced or cleared funds are not received. There is no existing contract between you and the Supplier for the sale of any products until the Supplier has received and accepted your order. The Supplier may change these Terms & Conditions without notifying you in regards to future sales.
WARRANTY
If the products supplied contain a manufactures warranty, then all warranty issues should be directed to the manufacturer not the seller. The Seller warrants to the Buyer that the Goods are of the same quantity, description and quality as set out in the Order. All goods supplied by the Supplier are warranted free from defects for 12 months from the date of supply. Where there is a breach of the warranty contained in this section by the Seller the Buyer shall inform the Seller who must within 28 days either repair or replace the defective Goods at the Seller's expense or repay the Price or part of the Price relating to the defect to the Buyer. The Seller shall ensure that all the Goods shall be manufactured, stored, tested and packed in accordance with all British and EC statutory and other legal requirements applicable to them and that all the Goods are of merchantable quality and fit for the purpose for which the Buyer intends to use such Goods. All original packaging must be kept for purpose of returns and warranty purposes.
DELIVERY
The goods you order will be delivered to the address you give when you place your order. The Supplier will endeavor to deliver the required products at the specified date and time, however there is no contractual obligation as this is subject change due to circumstances beyond the suppliers control. Standard delivery prices and times are subject to customers location being in the mainland UK and also product and courier availabilty. We will endevour to meet the individual delivery requirements of all our customers, so if the delivery is outside the mainland UK the cusotmer should contact the supplier to make special arrangements. If delivery cannot be made to your address due to complications the Supplier will inform you as soon as possible. The supplier will not be liable for any loss or damage arising from delay in delivery. For collection orders paid by credit card the card owner must be present before or on collection. Upon receipt of your order you will be asked to sign for the goods received in good condition. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the point of delivery then please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty claims that you make thereafter.
PAYMENT
Payment for the goods and delivery charges can be made by any method shown on the Supplier's website at the time you place your order. Payment shall be due before the delivery date; failure to do so entitles the Supplier to terminate the contract immediately. If you wish to place a bank tranfer from a bank outside the British Isles, please contact us first to confirm the details.There will be no delivery until correct cleared funds are received.In the event of a wrong amount being transfered into the sellers account, the sellers accepts no liability to pay the costs of a refund. A valid VAT invoice in respect of the price shall be produced to the Buyer by the Seller. In the event of any variation or suspension of orders through the buyer's instructions or lack of instructions, prices may be increased to cover any extra expenses thereby incurred by the Company. All prices are subject to change without notice. In the event of any clerical error or omission in any sales literature, quotation, price list (including the Internet) or other document issued by the supplier, the company reserves the right to correction without any liability.
DESCRIPTION AND PRICE OF GOODS
The description & prices of the goods you order will be as shown on the suppliers website at the time you place your order. These goods are subject to availability and price changes. If the goods you have ordered are not available or has changed in price we will inform you as soon as possible. Goods are not supplied on a trial basis. Customers are responsible for verifying suitability and compatibility of equipment and applications before purchasing them. In addition to the price, you may be required to pay a delivery charge for the goods. Every effort will be made to ensure that prices shown on the Supplier's website are accurate at the time you place your order. If an error is found within 14 days of accepting your order, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order.
RETURNS
If for any reason you wish to you return your goods, you can do so within 7 days of the delivery of the goods. All returned goods must be accompanied by the appropriate invoice and delivery note. Unwanted items returned after 7 days from date of delivery for refund or exchange, for whatever reason, will be at the discretion of the company and if accepted will be subject to a re-stocking charge of 25% or more of the purchase value. Software items will not be accepted for return unless the goods are faulty or the shrink-wrap or copyright seal is intact. Items returned as faulty but found to have no fault may incur a testing charge. Please note that goods returned without their original packaging or incomplete or in any way not in full resalable condition will not be refunded and will be returned to you. One of our technicians will inspect your goods prior to replacement or refund and we reserve the right to deem the goods not fit for return. Proof of purchase must be provided along with a proof of dispatch that must be retained until a safe receipt is acknowledged by the seller. All software packages and extended warranties must be returned unopened and unregistered and laptops and systems must be restored to their default factory settings. Failure to do restore the laptops to default settings may incur a technician's fee. You will be refunded the value of your order less carriage and any card / finance charges within 30 days of us receiving your goods. Please package any returned items carefully and return them, for your own protection, via a recorded and insured method of carriage. The carriage costs and insurance are the responsibility of the buyer unless the goods were delivered to you in error. All packaging material should retained until the goods are fully tested and functional. If goods are returned they should be returned with the original packaging.
TITLE AND RISK
The goods are at the buyers risk from the time and acceptance of delivery. Title and risk of the goods shall not pass to you until the Supplier has received payment in full in cash or cleared funds.
CANCELLATION
You have the right to cancel the contract at any time up to the end of 7 working days from date of delivery. All cancellations must be confirmed in writing, fax or email, giving details of goods ordered and delivery, notification by phone is not sufficient. Acceptance of cancellation of an order shall be at the discretion of the Company. You will be responsible for returning the goods to the Supplier at your own cost. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. If the goods are specially requested by the customer, the Company might decide at its discretion not to allow cancellation. You do not have the right to cancel the contract if the order is for computer software which has been unsealed by you, or for consumable goods which, by their nature, cannot be returned, save where a fault is discovered which could not have been discovered otherwise than by unsealing the goods.
LIMITATION OF LIABILITY
Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Supplier's negligence or fraudulent misrepresentation. The supplier shall not be liable for any financial consequential indirect or other losses suffered by the Customer or any third party whether such loss arises in contract or tort or in any other way.
FORCE MAJEURE
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.
SEVERANCE
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any Court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
DATA PROTECTION
We will take all reasonable precautions to keep the details of your order secure but unless the company is negligent, we will not be liable for unauthorised access to information supplied by you.
GOVERNING LAW
Unless otherwise agreed in writing these terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract, save that consumers resident in Scotland shall have the right to insist upon these terms being construed in accordance with the laws of Scotland and to submit to the jurisdiction of Scottish courts.
